The proposal covered the redevelopment of the Bus Station Car Park site on Lord Street, Douglas, Isle of Man, for a mixed-use scheme including residential units, retail units, a combined Police Station and Library unit, and car parking. The permission granted was in principle only, meaning no development could take place until full details of siting, design, external appearance, internal layout, means of access, and landscaping were submitted and approved as reserved matters. The approval was time-limited to two years from the date of the notice, within which the reserved matters application had to be made.
The application was permitted in principle, with the detailed design, layout, access, and landscaping left to be resolved through a subsequent reserved matters application. Four conditions were attached to the permission, including the requirement that reserved matters be approved before any work on site could begin.
Condition 1
This approval is in principle only and will remain valid for a period of two years from the date of this notice, within which time no development may take place until such time as details of siting, design, external appearance, internal layout, means of access and landscaping (“reserved matters”) have been approved by the Department of Local Government and the Environment; these reserved matters must form the subject of a single, detailed application, and must comply with the design concepts as contained within the Planning Support document, submitted by the applicant on 20 June 1997, except insofar as amendment or clarification thereof is required by subsequent conditions of this notice.
Condition 2
No building shall extend West of a line drawn from North Quay to Lord Street along the Eastern edge of the access road from North Quay adjoining the Clarendon Hotel; beyond the Western edge of the buildings, and between Lord Street and the back of the block including the Douglas Hotel and the Clarendon Hotel, there shall be formed a civic space; service vehicles shall be permitted into this civic space only between 8.00 am and 10.30 am.
Condition 3
The detailed design must include the following provision: (a) a lay-by for 5 buses on the Lord Street frontage of the site, together with a covered bus shelter/waiting area and public toilet facilities, and a single staff-room with staff toilet and canteen; (b) 3 taxi rank spaces on the Lord Street frontage of the site; and (c) a minimum of 160 car-parking spaces at basement level, and a minimum of 5 car-parking spaces at ground level, suitable for use by disabled people and parents with children requiring access to retail units.
Condition 4
Prior to the commencement of the detailed design process, the developer must consult with the Highway Authority to establish the alignment of any highway widening scheme for Parade Street and its junction with Lord Street.
