Governor in Council Decision Letter
Dear Mr. Hamilton
The T. and C. Planning Act 1981 P.A. 97/528:
I refer to the Special Inquiry held under the terms of Part I of the T. and C. Planning Act, and now enclose a copy of the report of the inspector appointed to provide over the inquiry.
The Governor in Council has considered this report, but does not agree with all of the inspector's conclusions, and has not accepted the recommendation that the application should be refused. In particular, the Governor in Council judges that, in practice, it should prove possible for the developer to establish by consultation with the appropriate Government Dept.'s the various requirements for road widening and the possible police station or library; once these requirements have been established, these requirements are most unlikely to
prejudice the principle of the proposed development.
The Governor in Council has therefore concluded that it would not be premature to grant approval in principle, and has directed that the Dept. should be directed to issue a notice of approval in accordance with section 2(1) of the Act. The conditions of approval which should be obtained are in general are set out in the appendix to this letter, and are in general accordance with paragraph 59 of the report.
