The application site forms the curtilage of the Tynwald Restaurant, Main Road, St Johns. The property is a two storey building, prominently located on the corner of Station Road and Peel Road and to the immediate south of Tynwald Hill.
The application site is located within an area zoned as an "Area of Retail" in the St Johns Local Plan (Planning Circular 6/99).
There are no specific policies contained within the adopted Strategic Plan that refer to this type of development and therefore the application should be considered against the provisions of General Policy 2 which states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Planning application 07/01232/B sought permission for the construction of a conservatory and a new entrance. Also proposed was an external staircase to the Station Road elevation and a single door to replace the double door to the front elevation. In addition, a flat roof extension was proposed to the rear to provide improved toilet accommodation. This application was approved by the Planning Committee 28th September 2007.
This application proposes a revised scheme to the previously approved refurbishment proposal. The main changes from the previously approved scheme consist of an increase in the length of the conservatory and revisions to the conservatory roofline which would extend higher up the façade. Also proposed is a more prominent central entrance to the west elevation with the projecting gable being continued at first floor level. The rear extension would be reduced in length with revised steps and associated railings being installed.
The Department of Transport Highways Division does not object to this application. German Parish Commissioners indicate no objection to this application. The Department of Transport Drainage Division does not object to this application subject to a condition. We have received no privately written representations in relation to this planning application.
The proposed revisions are considered to represent an improvement over the previously approved scheme creating a bold façade to what is a principle elevation of a prominent building. The rear extension would be smaller than previously proposed and the addition of windows and a more refined external staircase arrangement would be an enhancement.
The proposal is considered to be acceptable and without detriment to the visual appearance of the building or the street scene.
It is recommended that the application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the alterations and extension as shown by the plans and information 2195/1, 07 NK 630 13F, 07 NK 630 14F, 07 NK 630 15F and 07 NK 630 16F submitted and date stamped 30th November 2007.
C 3. There must be No discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.
C 4. There must be no discharge of fat or other food waste to the public foul sewer.
N 1. It is noted that the surface water from the property is to be discharged via a soakaway. The use of soakaways are subject to Building Control approval and if this approval is not granted, the Department of Transport Drainage Division would not give permission for the discharge of surface water into the existing foul system and an alternative means of disposal would have to be sought.
~~N 2.~~ It will be the responsibility of the developer/occupier of the premises to provide satisfactory means of disposal for such waste.
