This application was permitted by the Planning Committee and following an appeal, requested by the owners of Westhall Farm, this approval was confirmed. Reference is made in the officer’s report to Strategic Plan policies and Planning Circulars and it was resolved that permission was appropriate as the site is designated as Low Density Housing in Parkland rather than countryside and that the converted barn would complement the existing house and its setting.
The approval is due to expire on 12th December, 2011.
One of the conditions of the approval was that:
> “Prior to the commencement of works on site in connection with the development hereby permitted, the applicant must have approved by the Planning Authority a plan showing existing and proposed levels in relation to Ordnance Datum around the barn, together with a finished floor level for the barn including the extension to ensure that the building will be above the level equivalent to a 1:100 year flood level and if not, any further work required to prevent the building from flooding. Note: the information provided from the Department of Transport Drainage Division suggests that the building will be above this level”. (condition 5)
The Isle of Man Water and Sewerage Authority has been consulted and has indicated that the development is above the 1 in 100 year flood level associated with the Silverburn. The finished floor level of the barn is to be 42mm above the level of the top of the bund erected on the Poacher’s Pocket site on the other side of the river.
There is no evidence that the barn accommodation will be at risk from flooding or that the works will increase the risk of flooding elsewhere. As such this information is considered to satisfy condition 5 of the approval issued.
