Permission was granted for the erection of a detached garage at Bluebell Cottage, Patrick Road, St Johns, Isle of Man. The proposed garage was to be located north of Patrick Road, across the River Nebb, accessed by an existing bridge, and sited on an area of existing gravel within the cottage's garden. The officer report noted that although the land carries an open space zoning, it had been landscaped with garden features and reads as a domestic garden rather than open space in the landscape. The officer recommended approval and the Planning Committee agreed, granting permission on 2 July 2007 subject to six conditions.
The Planning Committee approved the application for a detached garage at Bluebell Cottage. The garage was to be sited on an existing gravelled area within the garden, accessed via an existing bridge over the River Nebb. Six conditions were attached to the permission.
Policy OS/P/1 St John's Local Plan
The application site lies within an area zoned as Open Space in the St Johns Local Plan and as such, Policy OS/P/1 is considered in the determination of the application.
Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This approval relates to the plans and information submitted as part of this application and date stamped 1st March 2007.
Condition 3
The garage hereby approved may only be used for garaging and storage purposes incidental to the enjoyment of Bluebell Cottage and for no residential purpose.
Condition 4
The adjoining watercourse is classified as a "Main River" therefore an 8 metre deep corridor along the adjoining river banks must be maintained free of any development under the terms of the Land Drainage Act 1934. This is to enable the Department of Transport (or its successors) to carry out maintenance works on the river.
Condition 5
No development may take place within 8 metres of the adjacent watercourse, to prevent damage and disturbance to the river bank and river bed.
Condition 6
During construction works every effort must be made to safeguard against water pollution to the nearby watercourse from any surface run-off and sedimentation.
