The site represents the curtilage of Allandale Farm, Ballamanagh Road, Sulby, indicated within the red line on the submitted location plan, on the northern side of the Ballamanagh Road and south of Sulby Village.
The application site is within the area covered by the Sulby Local Plan Order 1998. Under this the application site is within an area recognised as being in an area of open space (including agriculture). Under the Isle of Man Development Plan Order 1982 the site is zoned as High Landscape Value or Costal Value and Scenic Significance.
The application seeks approval for the retention of vehicular access.
Lezayre Parish Commissioners have refused the application on the grounds that:-
Access is already available onto the site. When this temporary access was created (without permission) we were assured that the bank / hedge would be reinstated as soon as the flood retention scheme was finished.
Highways Division do not oppose, subject to the imposition of the following condition:-
The Manx Electricity Authority makes no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.
We have received no private representations objecting to the application.
The access was created to enable heavy vehicles to access the field to the north of the access to carry out flood retention works. This is now complete and the applicant now wishes to retain this entrance to provide access to their field, farmhouse and to a new barn which has benefited from an Approval in principle application (06/01803/A).
The property Allandale Farm does not have any other way to access the field to the rear. Originally, the existing barns / access to the northeast formed part of Allandale Farm, however the applicant where not in a position to buy the barns when they bought Allandale Farm and the land connected. Therefore this access is considered to be justified, particularly as this will allow the applicants to farm the land to the north, which from the information received in the previous application (06/01803/A), involves lambing.
Regarding the appearance of the access, currently the access is not particularly attractive; therefore discussions have taken place with the applicant who is happy that part of the access will be hardstand (tarmac), therefore a condition should be attached with any given approval which required an additional plan indicating the exact area to be hardstand.
For these reasons the proposal would be appropriate in this location and therefore my recommendation is for an approval.

C 1. This approval relates to the retention of the existing access as proposed in the submitted documents and drawings 00303/1 and 00303/2 received on the 16th February 2007, 2nd October 2007 and 2nd February 2008.
C 2. Within one month of this decision becoming final, there must be submitted to and approved by the Planning Authority, detailed scaled drawing showing the area of the access to be hard-surfaced.
C 3. The applicant shall contact the Network Planning Section of the Department of Transport prior to the use of this access to arrange for the erection of a Road Traffic Mirror. Telephone 686600.
