The site represents the curtilage of an existing dwelling which sits, together with the recently constructed replacement cottage and new garage which also belong to this applicant, to the west of the Ballamodha Straight (A3). The site is accessed via a single track lane which passes two other properties – San Remo and Curlew Cottage.
The site lies within an area of "white land" on the Isle of Man Planning Scheme (Development Plan) Order 1982.
Planning permission has been permitted for a number of developments on the site, including - alterations and extensions to the outbuilding to provide additional living accommodation (PA 02/1721), erection of a replacement outbuilding as above (PA 03/0694), re-building of the existing agricultural outbuilding (PA 04/2048) and permission is currently being sought for the rebuilding of the main house (PA 07/0059).
Proposed now is the creation of a lake to the south west of the house and to the west of the rebuilt accommodation. The lake would be within the area associated with both properties.
The lake would have a diameter of 24m and would replace a previous surface water holding arrangement which is no longer needed due to better drainage which has been introduced to the site by the owner. Water will fill the pond from surface water collected from the house and cottage roofs and overflow will be to the outfall drainage system which is presently being introduced.
The pond will be around 0.9m deep with a rockery and steps leading down to it from the west.
The pond will be visible from the north from the Corlea Road (B39) but will not be intrusive. The pond may well attract wildlife in the area and will not adversely affect either the amenities or setting of the existing properties on site nor those in the vicinity.
There is no intention in the application for this to be a public facility and as such the suggestions of the Disability Access Officer to have disabled persons' access and facilities are not such as to warrant being included as a condition.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Disability Access Officer's comments relate to a public facility which this is not and as such should not be afforded party status in this instance.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the creation of a lake as shown in drawings 1493.05.P01 and -P02 both received on 23rd January, 2007.
N 1.
The applicant should note that permission is required under the Land Drainage Act 1934 written permission is required from the Department of Transport for any work carried out on any watercourse including discharging into a ditch. The applicant is advised to consult the Department of Transport in this respect.
