The application sought retrospective permission to retain and complete a holiday cottage on the site of a former byre to the east of the main house at Goldies Loughan, Jurby East, on the southern side of the B3. The site lies in an area not zoned for development. The completed building would measure 14.7m by 4.4m, rising to 4.2m at the ridge, with an additional outrigger on the east elevation. Only one gable end of the original byre remained, meaning the structure was effectively a new building rather than a conversion. The Planning Committee refused the application on two grounds. First, retaining the cottage was treated as equivalent to creating a new residential dwelling in the countryside, contrary to the Isle of Man Planning Scheme 1982, Planning Circular 1/88, and Planning Circular 3/89, which prohibits replacement buildings of similar or identical form.
The committee refused because the building was effectively a new structure rather than a conversion of the original byre, making it tantamount to a new dwelling in unzoned countryside contrary to the Isle of Man Planning Scheme 1982 and relevant planning circulars. The associated access was also refused retention as it served an unauthorised building and caused visual harm to the character of the area.
