THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling that is located on King Edward Road in Onchan. The proposed development comprises of the erection of a garage with ancillary accommodation above in the rear garden of the dwelling.
Whilst the application site has been subject of a number of previous planning applications there is only one that I consider specifically material to the assessment of the current planning application. Planning application 05/01797/B sought approval for the erection of a garage with ancillary accommodation above on the application site. This previous planning application was initially considered and refused on the 11th November 2005, with the initial refusal decision notice issued on the 22nd November 2005. The Planning Committee confirmed the refusal at review on the 10th February 2006, with the review refusal decision notice issued on the 20th February 2006. The Minister subsequently accepted the recommendation of an appointed Planning Inspector and approved the planning application on the 5th June 2006.
Onchan District Commissioners recommend that the planning application be approved.
The Department of Transport Highways Division do not opposed the planning application.
The application site is within an area recognised as being within predominantly residential use under the Onchan Local Plan.
Policy O/RES/P/21 of the written statement (Planning Circular 1/2000) that accompanies the Onchan Local Plan states:
"Extensions and alterations to existing residential property will generally not be opposed where such proposals are appropriate in terms of scale, massing, design, appearance and impact on adjacent property."
The development proposed by the planning application takes the form of previous planning application 05/01797/B, albeit with amendments to take account of the conditions that were imposed on that previous planning application. The applicant could legitimately make submissions to address the proposed development by means of the previous application. However, for whatever reason they have chosen not to do this and to submit the current planning application, which is also a legitimate course of action. Due to the conclusions and outcome of the previous planning application I have to conclude that the proposed development is acceptable. I therefore recommend that the planning application be approved.
I consider that all parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the location plan and drawing no. AT756.2 date stamped the 30th June 2006.
C 3. The glass annotated as being obscured, as shown on drawing no. At756.2 date stamped the 30th June 2006, must be glazed and maintained thereafter using obscured glass with a level of obscuration no less than level 5 as detailed on the Pilkington's textured glass range or equivalent.
C 4. The accommodation hereby permitted above the garage may be used only in association with the main house, no. 115 King Edward Road, and for purposes ancillary or incidental to its use as a single dwellinghouse.
C 5. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no windows shall be constructed on the roof slopes of the building hereby approved.
