Department Of Local Government And The Environment ### Memorandum To: Senior Planning Officer From: Miss Sarah Corlett, Planning Officer Subject: PA 05/92127 – approval in principle for creation of football ground with associated facilities, field 424828, south of Colby Station, Station Road, Colby, Arbory Date: 30th October, 2008 ### Extension Of Time The application was approved by the Planning Committee and confirmed on appeal on 20th November, 2006. The applicants submitted a reserved matters application which was recommended for approval but when considered by the Planning Committee was refused, following a discussion about the use of the pavilion building and the submission of further information. The applicants requested an appeal against this refusal and the appeal was due to be considered next Thursday, 6th November, 2008 but has been withdrawn. The applicants are discussing a number of alternatives bearing in mind the opposition to the scheme in terms of the size of the building which is significantly larger than was shown in the approval in principle in addition to concerns about access and the alterations to Cubbin’s Bridge, which has resulted in a lot of local opposition. The applicants are not in a position to finalise any of these alterations, which would result in a new application, and which may not, in any case be able to rely upon the approval in principle if a different access is proposed. However, they would like to be able to rely upon an extant approval in principle when any subsequent application is submitted, regardless of whether any subsequent application is for reserved matters or not. The terms of the approval in principle have not been altered by the submission of the application for reserved matters – the building shown in the reserved matters application is significantly larger than that shown in the approval in principle and would have lead to different and greater levels of traffic which were neither contemplated nor discussed at the time when the approval in principle was being considered. As such, it is considered that the principle of the creation of football playing facilities as were approved in the approval in principle, is still acceptable. As such, it is recommended that the approval in principle is extended for a further two years to enable the applicant to prepare alternative plans which either comply with the terms of the approval in principle or a different scheme which addresses the reasons for refusal of the reserved matters application, PA 07/2055.
