In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs K Bettridge Proposal: Approval in principle for the erection of a detached dwelling and garage at: Land At Ballaglea Cottage Ballamodha Straight Ballamodha Ballasalla Isle Of Man IM9 3AZ
which was considered on 8 February 2006, for the reasons set out below.

Reasons For Refusal:
- The site is not designated for development. No information has been supplied with the application to persuade the Planning Committee that there is any reason why this policy which presumes against development in the Island’s countryside, should be set aside in this case. As such, the development would represent an intrusion into the countryside and establish an unfortunate precedent for further unwarranted development in this area. Whilst the site is part of an existing residential curtilage, use as a residential curtilage carries with it no assumption in favour of further built development within that curtilage (see PA 93/1544).
- The visibility splays available to drivers emerging from the B39 onto the A3 are inadequate to serve this development.
- This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
