This application sought approval in principle for a detached dwelling and garage on land forming the residential curtilage of Ballaglea Cottage, situated on the western side of the Ballamodha Straight (A3) just south of its junction with the Ronague Road (B39) in Malew. The application was refused in February 2006. The site is not designated for development, and the applicant provided no information to justify departing from the policy that presumes against development in the Isle of Man countryside. Planners noted that being within an existing residential curtilage does not carry any automatic right to further built development within it, and that approval would set an unfortunate precedent for unwarranted development in the area. A second reason for refusal was highway safety: the visibility splays available to drivers emerging from the B39 onto the A3 were considered inadequate to serve the proposed new dwelling.
The application was refused on two grounds. First, the site is not designated for development and no justification was provided to set aside the policy presumption against building in the countryside; the existing residential curtilage does not in itself support further built development. Second, the visibility splays at the junction of the B39 and A3 were found to be inadequate for the traffic generated by the proposed dwelling.
