The proposal involved erecting a conservatory on the flat roof of an existing rear balcony at 44 Patrick Street, a semi-detached house on the western side of Patrick Street within Peel's Conservation Area and an area designated as Residential under the Peel Local Plan. The conservatory was intended to extend the usable living space within the property. The main planning concern was potential overlooking of neighbouring properties, which was addressed by fitting both side walls with frosted glass. The officer wrote to the other adjoining neighbour but received no response, and on that basis recommended approval.
The application was approved under delegated powers with three conditions.

Condition 1
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Condition 2
This permission relates to the erection of a conservatory as shown in drawings 1882/1, -/2 and /3 all received on 29th September, 2005.
Condition 3
The north west and south eastern elevations (those facing towards number 42 Patrick Street and "Ballacosnahan") must be fitted with obscured glass so as to prevent overlooking of these properties from the proposed conservatory, and such glazing retained as such in perpetuity.
