Officer's Report
This application relates to the curtilege of 12 Close -Y-Locker Union Mills.
The retrospective application is for a garden shed 2.744m x 2.744m x 2.134m high. This replaces a previous garden shed which was 3.048m x 2.438m x 1.98m high. At the time they sought permission from Braddan Commissioners who gave permission for the shed but did not inform the applicant that he would require planning permission. The shed is used for storage of garden equipment DIY stiff, cycles and motobikes. There are five people in the house and the only internal storage is some space under the stairs. The applicant states they did not knowingly break the planning regulations.
Braddan Parish Commissioners state they would recommend approval of the application subject to a condition requiring that the shed be relocated to a distance of 2 metres away from the existing boundary between the semi-detached properties.
The shed is located approximately half a metre from the boundary with the adjoining semi and just 0.32 metre from the house. It is directly in front of rear window to the house and will restrict the view for the applicant from that window. The impact on the neighbour however is less and the neighbour has not been objected. The view from his side is very similar to that being a fence along the boundary which could be permitted development if no higher than 2 metres. The gardens are small to the rear but overlook open space beyond so the feeling of enclosure is less than it might otherwise be.
Since the greatest adverse impact is on the applicant’s property and the structure would have a limited life, and a similar impact on the neighbouring property could be obtained by a fence under permitted development it is considered the shed should be permitted. Moving it away from the boundary by 2 metres would leave an unaccessible space behind which could end up more unsightly than the shed near the boundary and not change the impact of the shed to any great extent.
