In pursuance of its powers granted under the above Acts, Order and Regulations, the Planning Committee of the Department of Local Government and the Environment does hereby REFUSE development of the under-mentioned registered buildings in accordance with the application made on behalf of:
Name: Street Heritage Ltd Proposal: Retrospective Registered Building Consent for amendments to approved conversion to apartments (02/02129GB, 03/01474GB and 04/00468GB)(In association with 05/00282GB) Refusals in accordance with drawings 02/PMC-505,305/306/307 and 308.
at: Chapel Court Christian Street Peel Isle Of Man IM5 1NW
which was considered on 11 August 2005, for the reasons set out below.

This refusal relates to the alterations as set out in the plans submitted with the planning application noted in the proposal.
REASONS FOR REFUSAL:
- The Planning Committee judges that the applicant must either reinstate or remove the:
- Louver on round windows to the front of the building;
- Decorative terracotta feature from the wall at front of the building;
- External front lamp feature;
- Up- lighting to the side of the building (Mona Street);
- Feature lamps from Mona Street elevation;
- Air conditioning unit on Mona Street;
- Ornamental bell to the Philip Christian Centre side;
- Satellite dish on Mona Street next to air- conditioning unit;
- Air conditioning unit on flat roof of dormer overlooking the Philip Christian Centre; and
- Excessive lighting/wattage to the front of the building.
It determined that these were inappropriate forms of development on this attractive and important building which is both a Registered (Building 194) and within the Peel Conservation Area. These elements would represent incongruous features which would be out of keeping with the former Methodist Chapel and would detract from the character and appearance of the building and its setting in the Conservation Area alongside the Philip Christian Centre (Registered Building 89).
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
Note 1: The decision contained in this notice does not become final until:-
- the time for requesting an appeal has expired; or
- any appeal has been completed.
Note 2: Rights of appeal against the decision of the planning committee are attached.
Note 3: An appeal may be requested within a period of 21 days.
Note 4: If this determination is running concurrently with a planning application which is to be the subject of a planning review, the content of the registered building application is excluded from that consideration. If need be an appeal against the determination of registered building consent must be made independently.
