In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

Name: Drummond Developments Proposal: Erection of two four storey blocks, each block containing eight flats at: St Olaves Kitchen Garden Bowring Road Ramsey

which was considered on 10 March 2005, subject to compliance with the conditions specified below.

Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

1. This approval relates to drawing no.s 12, 13, 14, 15, 16, 17 and 18 date stamped the 8th November 2004.

1. Prior to the commencement of any works related to the implementation of this development drawings detailing appropriate sightlines and visibility delays in respect of the vehicular access and egress arrangements must be submitted to and agreed by the Planning Authority.

1. No development shall take place until full details of associated landscaping works have been submitted to and agreed by the Planning Authority, after which time these works shall be carried out as approved. These details shall include a schedule of planting (noting plant species, size and density) and hard surfacing materials.

1. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

1. All services including electricity and telephone where installed must be laid underground.

1. Prior to the commencement of development samples of the materials and details of the proposed colour finishes to be used in construction of the external surfaces of the development must be submitted to and agreed by the Planning Authority.

1. Prior to the occupation of any of the apartments the car parking must be constructed and be capable of use.

1. The foul water and surface water disposal arrangements must be in accordance with the requirements of the Drainage Authority.

NOTE The applicant/developer is advised to consult with the Department of Transport Highways Division prior to the submission of any drawing(s) relating to condition no. 3.

NOTE The applicant/developer is advised that on completion the apartments must comply with requirements of the Housing (Flats) Regulations 1982 and be registered thereafter under the same regulations.

NOTE The applicant/developer is advised that the development falls within the scope of the Fire Precautions (Flats) Regulations 1996 and is recommended to contact the Fire Safety Department in this regard.

NOTE The applicant/developer is advised that for connections to flats and apartments the following apply - "Water Supply to Flats and Apartments - Regulations" and if applicable a "Form of Undertaking in Respect of Supply Pipes" will be required. Copies of these documents can be obtained from the Isle of Man Water Authority or alternatively by contacting the Isle of Man Water Authority Byelaws Inspector (Les Quayle), tel. 01624 695957.

NOTE The applicant/developer is advised to consider the comments of the Disability Access Office.

NOTE The Planning Committee wishes to expresses its hope that discussions with the Department of Transport regarding improvements to the junction of Jurby Road and Bowring Road continue and that any such improvements can be satisfactorily achieved.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -

• the time for requesting a review of the initial decision has expired; or
• any review of the initial decision has been completed; or
• the time for requesting an appeal in relation to the decision has expired; or
• any appeal has been completed.
