Officer's Report
The site represents a small square piece of land on the southern side of the A26 St. Mark's Road from the Braaid to St. Mark's. The site is within an area designated as Woodland on the 1982 Plan.
Previously, permission was granted for the erection of a storage building to replace existing store (PA 04/0013). This was approved and the officer's report notes that the use of the site is a tree surgery depot although no permission was ever sought or granted for this. Previous approvals - 97/1283 for the erection of a replacement shed (for the same applicant) did not query this.
Check on site for tree impact and query need and justification (none is given in the application).
I visited the site today and observed that the building approved under 04/0013 is already in place and there was one large vehicle parked alongside it.
I will write to the applicant's agent requesting clarification of the use and need.
The applicant has responded (letter of 10th December, 2004) explaining that he has more vehicles than he can accommodate in the existing building and has experienced vandalism and theft from the property, rising insurance costs and better inside accommodation for protection of his equipment and implements which he lists in his letter. He confirms that the tree to the rear of the site should not be affected due to the nature of the construction of the new buildings.
In accepting the erection of one building on this site, we have accepted the establishment of the business here and the applicant has provided further information which supports the need for additional buildings. The site is contained and the approval of this building should not establish a further precedent for further buildings on the site.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the erection of a new building attached to the existing as shown in the elevational drawing, location plan and plan reference 390/1 all received on 19th October, 2004.
C 3. The site and building may only be used for the storage of arboricultural plant and associated equipment.

It should be noted that it is an offence under Manx legislation to permit the discharge of polluting or harmful matter to any public sewers or watercourses. Appropriate measures must be taken by the developer/user of the premises to ensure compliance with the legislation.

There must be no development within 8 metres of the watercourse to ensure habitat is retained, which may act as a wildlife corridor and also reduce disturbance to the watercourse, and decrease riverbank erosion.
