Why Was This Refused?
- ✓Proposal sought removal of an agricultural workers occupancy condition on an existing bungalow
- ✓Evidence submitted indicated ongoing interest in purchase tied to the property
- ✓The information suggested the dwelling may still be required for agricultural occupation
- ✓Removing the tie was viewed as creating a new countryside dwelling
- ✓Malew Commissioners objected to the application
- ✓The bungalow sits within the curtilage of an existing dwelling accessed via a farm lane through a farm complex
- ✓The information provided with the application indicates that there is interest in the purchase of the property with the tie, albeit at a reduce price.
- ✓As such there is evidence to suggest that this property may still be required for agricultural occupation and as such the removal of the tie would be unwarranted and would represent the creation of a new dwelling in the countryside where such would normally be resisted.
- ✓Malew Commissioners object to the application
The application sought to remove an agricultural workers occupancy condition on a bungalow at Gibdale Farmhouse, located within the curtilage of an existing dwelling accessed via a farm lane through a farm complex. Malew committee refused the application on the basis that the information submitted indicated the property may still be needed for agricultural occupation. It was considered that removing the occupancy tie would be unwarranted and would effectively create a new dwelling in the countryside, which was resisted. The Malew Commissioners objected to the application.
The committee refused the application to remove an agricultural workers occupancy condition attached to an existing bungalow at Gibdale Farm. The submitted information suggested there may still be a need for the dwelling for agricultural occupation. The removal of the occupancy tie was therefore considered unwarranted and would amount to creating a new countryside dwelling, which the Malew Commissioners objected to.
