Officer's Report
The site represents the curtilage of an existing, albeit dilapidated cottage on the Ballaglass Road off the A15 at Ballasloe, Maughold. Planning permission was granted on appeal for the redevelopment of the cottage (PA 03/0900). That approval required that the new dwelling is generally 11 by 5.5m with a possible single storey annex at the rear. Any garaging should be detached.
The proposed dwelling is traditionally designed and is 11m long and 7.5m wide but with no rear annex. The windows have insubstantial cills which is unsatisfactory but may be dealt with by condition.
The approval also required that details of the residential curtilage be provided - this has been defined as the land to the east of the water course which is acceptable.
DoT dd and ht are not satisfied with the details which have been submitted.
An amended plans received on 22nd August, 2005. These show an amended house type but still a traditional design (the sub-cills should be slightly deeper - 0.15m). The garage is to be almost 10m from the river. The concerns of the DoT dd have been addressed although the DoT ht have not indicated that they are now happy with the amendments.
Additional comments have now been received from DAFF who advise conditions regarding diversion of the watercourse.
I have contacted DoT regarding their views on the amended proposal and have yet to receive their comments. The amended drawings appear to address the concerns regarding visibility.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the erection of a replacement dwelling and new garage and access all as shown in drawing 050421-01 received on 22nd August, 2005.
C 3.
The subcills must be pre-formed concrete cills to a depth of 0.15m and the windows all timber framed sliding sashes all as shown in the approved drawing.
C 4.
No part of the development, nor any other works may be undertaken within 10m of the existing stream.
Note: the applicant is advised to liaise with the Inland Fisheries Section of DAFF in respect to works undertaken on the site.
C 5.
Prior to the commencement of works on site the applicant must supply to the Department of Transport's Drainage Division a full method statement relating to the proposed stream diversion and the applicant must ensure that all written permissions are obtained from the Land Drainage Engineer of the DoT for any works on the watercourse. The proposed surface water discharge to the watercourse must be via a spillway which must be constructed to the satisfaction of the Drainage Division.

The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
