Re: Planning Application PA.04/01941 Proposed change of use of Flat 4 to facilitate tourist use. Beachmount and Highcliffe, The Darrag, Port Erin, IM9 6JD
I refer to my letter dated 24 February 2004 regarding the planning application to change Apartment 4, Beachmount and Highcliffe, to facilitate tourist use. There is a further clause in the lease of the Beachmount and Highcliffe Management Company that would impact the decision to use an apartment for tourist purposes:
"Not at any time during the term hereby granted to divide the possession of the demised premises by an assignment or underletting and not to assign underlet or part with possession of the demised premises or the Lessor's fixtures and fittings without the prior written consent of the Management Company which shall not be unreasonably withheld in the case of a reasonable tenant and to be determined by the Management Company in accordance with the financial standing and reputation of any prospective assignee or underlessee PROVIDED HOWEVER that any breach of the conditions hereinbefore mentioned in paragraph (i) hereof shall be a sufficient reason for refusal to agree to any assignment or sublease PROVIDED ALWAYS that this provision shall not prevent the Lessee granting furnished lettings for any period not exceeding six months of which previous notice shall have been given to the Management Company."
In this instance, it would be difficult to check on the financial standing and reputation of 'tourists' in advance.
