Dear Sir/Madam,
Re: Planning Application PA.04/01949 Proposed change of use of Flat 4 to facilitate tourist use. Beachmount and Highcliffe, The Darrag, Port Erin, IM9 6JD
I am Director and Secretary of the Beachmount and Highcliffe Management Company Limited.
In that capacity, the Clerk of the Port Erin Commissioners brought to my attention the above application to change the use of Apartment 4, Beachmount and Highcliffe, to facilitate tourist use. He was directed by the Commissioners to enquire if there are any covenants on the property concerning the use of the premises for tourist purposes.
I reported to the Commissioners that there is a covenant clause in the lease of the Beachmount and Highcliffe Management Company Limited on all the apartment owners stating:
"Not to use the demised premises nor permit the same to be used for any purpose whatsoever other than as a private dwelling only, nor for any purposes from which a nuisance can arise to the owners, lessees or occupiers of the other parts of the Estate or in the neighbourhood."
Unfortunately, the other apartment owners and I were unaware that the application had been made to the Planning Office.
In addition, I drew the Commissioners' attention to the Certificate of Registration in which the maximum occupancy of Apartment 4 is 4 persons.
Consequently, I wish to make the Planning Office aware of these issues when considering the current planning application for Apartment 4.
