Officer's Report
The application seeks the erection of an agricultural building on a farm in Andreas. The proposed building, which is understood to be required as part of the farm assurance scheme, is located adjacent to existing farm buildings. I consider that the proposed building is well related to the existing farm group.
The development will require the removal of a number of trees and DAFF have highlighted their potential for birds and bats. Given that DAFF have their own protective legislation, Wildlife Act 1990,
and that there is no evidence of nesting birds or bats it would be inappropriate to base a refusal on these grounds or to apply a condition. However, a suitable note should be attached.
I recommend that the application be approved.

C 1 . The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2 . This approval relates to drawing no.s I, II, III and 2805-01 date stamped the 12th January 2004. N 3 . It should be noted that the Isle of Man Water Authority have advised that the development is located in close proximity to a distribution water main and that they should be consulted before any works commence.
N 4 . It should be noted that the Department of Agriculture, Fisheries and Forestry's Wildlife and Conservation Office have suggested that trees that are to be removed as part of this development may be used by nesting birds and/or bats. As the habitats of these animals are protected by the Wildlife Act 1990 the Wildlife and Conservation Office must be contacted prior to the removal of any trees in association with the development.
