The site lies on the western side of the industrial development land known locally as "the barley field" which has permission for the principle of light industrial and other development (PA 01/0111) and the layout of the road (PA 01/0110). Permission has been granted for the erection of a car hire and sales facility, two sets of light industrial starter units.
The site is a little over 100 metres in length and 60 metres deep. The site slopes gently upward from south to north by 2.5 m .
Proposed here is the erection of a new building for use as a sales and storage facility for tiles, building products and tools. ALI these things are presently sold at the Lake Road timber merchant's and tile centre although these are in two separate buildings separated by a roadway (the building products sold in one and the tiles and tools in the other). This site is designated as Town Centre- mixed use (residential/retail, light industrial etc) and predominantly residential and the relocation of the builders' yard would enable the development of the site in accordance with the ladn use policies in the Douglas Plan. The proposed building is 68 m by 30 m and 7.4 m high finished in microrib panels similar to the existing start unit buildings.
The proximity of the building to the existing hedge along the western boundary may necessitate the removal of existing hedge trees - chech this on site. The landscaping scheme proposes the planting of beech trees to continue the avenue provided in the development of the other sites (and suggested by Braddan Commissioners).
There is to be a fence erected around the site. This will be 2.5 m high and erected behind the beech avenue and perimeter planting. This is preferable to a wall and is necessary to prevent theft of materials. The Lake Road site has a barrier controlling entry and exit and staff who check loads exiting the site.
The views which have been received emanate from existing users of Spring Valley Industrial Estate and potential occupants of the Business Park, all of whom are concerned at potential pollution in terms of noise and particulates and the heavy traffic which would pass other users.
The proposed use is industrial in nature and there are limited other sites of the size required to accommodate it. It is important that the existing site is freed up for residential development both in terms of satisfying housing need and relocating a use which in terms of accessibilty is not suited to the town centre where it is currently located. The applicant has agreed to enter into an Agreement under the 1991 Act to cease the use of the existing saw mill site as such, within no later than twelve months of the commencement of the new use on the new site.
There is also a retail element which, in terms of the building materials is not suited to the town centre environment and as such could be permitted in industrial areas such as this. The tile centre is slightly different however in that there are tile shops in town (The Tile Shop on Buck's Road, Pacesetter in Harris Terrace (although they also have a showroom in Spring Valley - 31 -33). There are, however tiles suppliers which are already located in industrial areas (B and Q, Riverside Ceramics in Tromode Industrial Estate,Tile Tec at unit 10, White Hoe Industrial Estate). The applicants would argue that the tile shop cannot commercially be separated from the rest of the operation.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the erection of a timber saw mill building with associated tile shop, building products and tools, car parking and landscaping all as shown in drawings reference 01 and the fencing details both received on 15th January, 2004 and 02D, 03A, 08A all received on 16th February, 2004 and the lighting plan received on 2nd September, 2004.
C 3. The unit may not be used or occupied until the hardstanding forming the turning area and the parking has been completed and is available for use.
C 4. No water or contaminants from the site may flow or be tracked onto the highway by vehicle wheels. C 5. The fencing must be finished in dark green or black unless otherwise authorised by the planning authority and be erected as shown in the amended A4 photograph and not as shown in the in the Heras brochure received on 15th January, 2004.
C 6. Prior to the commencement of building works a sample of the external finish of the building must be approved by the Planning Authority.
C 7. The level of noise emitted from the sawmill plant shall not exceed LAeq, 1 hour - 40 dB daytime ( 0700 - 2300) and LAeq, 5 minute - 30 dB night time ( 2300 - 0700) as measured from the rear garden of The Smithy, Cooil Road. The rating level shall be measured and calculated in accordance with BS 4142:1997.
Note 1: "sawmill plant" includes any woodworking machinery, bag filters, compressors, ventilation plant and fork lift trucks.
Note 2: This is in order to protect the amenity of local residents. C 8. The noise level emitted from the sawmill plant shall not exceed LAeq, 1 hour - 50 dB daytime ( 0700 2300) at the site boundary as defined in drawing 01 received on 15th January, 2004. This rating level shall be measured and calculated in accordance with BS 4142: 1997.
Note 3: "sawmill plant" is as defined in condition seven above. Note 4: this is to protect the amenities of other businesses operating in the vicinity. C 9. The site and its buildings may only be used for the preparation and storage of timber and not for any manufacturing purposes.
C 10 . The height of any stored material may not exceed 4 m above ground level. N 11 . It should be noted that this development is also the subject of an Agreement under Sections 18 and 19 of the 1991 Town and Country Planning Act.
