The site represents a portion of the golf course at King Edward Bay. The site stretches from the clubhouse in the west to the eastern end of the Groudle Road just before its junction with King Edward Road.
Previously, planning approval has been granted for a series of infilling operations along this part of the course and much of this has been completed. A part remains to be done, next to the road. This has not been completed in accordance with the time constraints imposed in PA 00/1646. The drawings submitted for both are similar in that the top of the tipped material remains the same. However, the levels on the new sectional drawings do not correspond with those on the site drawing.

See photos. There is in view from Groudle Road a fairly smooth profile of the slope in the distance. In the foreground however there is a steep slope which is the part to be softened and infilled as is clear in the sectional drawings.
The work should be completed at the earliest opportunity although putting on a condition to this effect is unlikely to be any more effective than the last ones. They have stated that they require a further 18 months to complete. We should require this.
I have met again with the applicants (Tigh O'Mahoney and John McLaughlin) on site and they have also submitted further information in the form of photographs and drawings together with a letter dated 3/12/04. This explains that due to cancelled or postponed projects they are unable to guarantee the completion of the work within 18 months. Having spoken with the Director who feels that this vagueness and uncertainty is unacceptable - and the unfinished nature of this site has been apparent for several years - additional conditions should be attached to ensure that within twelve months if the additional fill required is not likely to be forthcoming, the slopes should be graded as they are - further plans approved and the lot seeded within the 18 months.

This approval relates to the continuation of infilling as shown in submitted drawings reference M3112-01 and M3112-02 received on 9.12.03.
Access to the site by vehicles must be only from King Edward Road using the roadway approved under PA 97/2134.
Once the infilling has been completed in accordance with the approved drawings, including a top layer of topsoil, the infilled area must be seeded in accordance with that of the remainder of the infilled area on this site.
The approved infilling must be completed, including seeding, within eighteen months of the date of this notice as it becomes final. If the material required to complete the works as shown in the drawings, is not likely to become available within the eighteen months allowed, the slopes must be graded on the
basis of the material which is available and on site within the appointed time. If the finished scheme is to differ from that approved on the basis of available material, plans illustrating the finished profiles must be approved by the Committee no later than fifteen months from the date of this notice as it becomes final, giving sufficient time to complete the profiles and undertake the seeding all within the eighteen months allowed.
I confirm that this decision accords with Government Circular No 57/01 (Delegation of Functions to Director of Planning and Building Control).
