Department Of Local Government And The Environment ### Memorandum TO: | Director of Planning and Building Control | | :-- | | FROM: Miss Sarah Corlett, Planning Officer | REF: PA 03/1902 - approval in principle for the erection of three dwellings on fields, 432533, 432534 and 432535, Phildraw Road, Ballasalla, Malew DATE: January, 2006 ### Extension Of Time The above application is in principle and proposes the development of three dwellings on a parcel of land which totals 3.16 ha ( 7.8 acres). The site is in its entirety within the area designated as Low Density Housing in Parkland on the Isle of Man Planning Scheme (Development Plan) Order 1982. Planning Circular 8/91 requires that such development represents new dwellings which sit comfortably in a setting of at least one acre of their own grounds and this proposal could easily comply with this. The site was previously the subject of an unsuccessful application for the layout of 7 dwellings ( 99 / 01175 / B ). The approval of the three plots was approved on 5th February, 2004 notice sent out on 11th February. The approved is due to expire on 10th February, 2006 and the applicant's agent now seeks an extension of a further two years. No explanation has been provided regarding the lack of progress on the reserved matters application. However there has been no change of circumstances in relation to the site or the designation of the site which is likely to be retained in any review of the development plan in this area. There was one letter from an adjacent resident who pointed out that the previous application for 7 dwellings had been refused but gave no further reasons why this application for 3 properties should be refused and no review was requested of the decision to approve the application. As such I would recommend that an extension of a further two years is permitted, resulting in the approval expiring on 10th February, 2008.
