The site sits adjacent to the Port St. The decisive planning concerns were threefold. First, the building's footprint and hard surfacing would require the removal of all existing trees on site, with no room for replacement planting, harming the character of the area and the setting of the Registered Buildings. Second, the building's height and proximity to boundaries — particularly the western elevation sitting just 1m from the boundary with the estate to the west, with four first-floor windows overlooking that development at well under the 20m separation recommended in the Residential Design Guidance — would cause serious harm to the amenity of neighbouring occupiers. 15/01008/B) demonstrated that a dwelling could be built on this plot without these adverse impacts, undermining any case that the harm was unavoidable.
The proposed dwelling was refused because its size, mass, and siting would require the removal of all on-site trees with no space for mitigation planting, produce an overbearing and overdeveloped appearance harmful to the character of the area and the setting of nearby Registered Buildings, and cause unacceptable overlooking and loss of amenity for neighbouring properties to the south and west.
