This retrospective application sought to regularise the erection of a stable and agricultural building at Ballachurry Beg, Summerhill Road, Jurby, Isle of Man. Because the buildings had already been constructed, the committee assessed whether they were acceptable in their completed form. The key planning issues considered were whether there was a genuine agricultural and equestrian need for the structures, whether they caused harm to the visual character of the area, whether they had an adverse effect on soils, and whether they created any highway safety concerns. The Planning Committee was satisfied on all of these points and granted permission, finding the proposal in accordance with General Policy 3 and Environment Policies 1, 15, 19, and 21 of the Strategic Plan.
The committee approved the application because the buildings were judged to meet an agricultural and equestrian need, did not cause unacceptable visual harm, had no significant impact on soils, and raised no highway safety concerns. The proposal was found to comply with the relevant policies of the Strategic Plan.
Condition 1
The agricultural building must be used only for agricultural purposes.
Condition 2
For the avoidance of doubt, the stable building hereby permitted shall only be used for equestrian purposes.
Condition 3
The agricultural building and stable hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for agricultural purposes.
