This application sought permission to alter and extend No. 10-12 Patrick Street, Peel — a two-storey end-terraced dwelling on the western side of Patrick Street — by erecting a second floor stairwell extension. The site sits within Peel Conservation Area, with No. 14 Patrick Street immediately to the south and Braeside adjacent to the northwest. The main planning issues considered were the effect of the extension on the residential amenity of the neighbouring properties and its visual impact on the dwelling as seen from the street and within the conservation area setting. The application was permitted on 17 March 2015, decided under delegated powers, subject to compliance with one condition.

The character of the Conservation Area should be encouraged by positive schemes of action which will apply to areas and individual buildings and include the historic pattern of streets and spaces.

9.15 THE CHARACTER OF THE CONSERVATION AREA SHOULD BE ENHANCED BY POSITIVE SCHEMES OF ACTION WHICH WILL APPLY TO AREAS AND INDIVIDUAL BUILDINGS AND INCLUDE THE HISTORIC PATTERN OF STREETS AND SPACES.
Particular attention will be paid to the alteration or extension of a building within the Conservation Area which must be carried out in a manner sympathetic to the existing building and its setting.

9.16 There will be a general presumption in favour of retention of retail uses at ground floor level in the main shopping streets (Peel Street, Bourne Place, Market Hill, Market Place (West), Parliament Street (excluding Auckland Terrace), East Street, Parliament Square (East side). Office uses (including finance related establishments) at ground floor level will not be permitted to occupy more than 30% of the street frontage in any one block between public and vehicular highways in these streets.
Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
