In pursuance of his powers under the above Act and Order, the Hon R A Ronan MHK, following consideration of the report by the appointed person, does hereby in the name of and on behalf of the Department of Infrastructure, APPROVE planning application 14/01203/B by Miss Diane Marchment for Erection of a detached dwelling with associated garage - Plot 2, Off Station Road, St Johns, Isle of Man, subject to the following conditions:-
- The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
- Prior to the commencement of works, a landscaping scheme shall be submitted to and approved in writing by the Department showing the trees and shrubs to be planted, together with a timetable for their planting. Particular regard shall be paid to the introduction of new trees and shrubs along the northern boundary of the site. The landscaping scheme shall be implemented in accordance with the approved details. If, within a period of 5 years from the date of planting, any tree or shrub is removed, uprooted, destroyed or dies, another of the same species and size shall be planted at the same place.
Reason: to enable the dwelling to sit comfortably within its environment.
- All existing trees and hedges within the application site shall be retained and afforded adequate protection during the development of the site, in accordance with a tree protection scheme that has been submitted to and approved in writing by the Department prior to the commencement of works. Unless and until the development has been completed, the protective fences shall not be removed, and the protected areas shall be kept clear of any building, plant, equipment, material, debris and trenching, and the existing ground levels maintained, and there shall be no entry to those areas except for approved arboricultural or landscape works.
Reason: To safeguard the existing trees on the site.
- Access to the dwelling shall be taken only from Station Road.
Reason: In the interests of highway safety.
- During the construction of the development hereby approved, deliveries of materials and equipment during term times shall not take place during the following periods: 08.00 to 09.00 hrs, 12.00 to 13.00 hrs and 15.30 to 16.30 hrs.
Reason: In the interests of highway safety, and to ensure that deliveries take place at times when school children are least likely to be on Station Road.
- Notwithstanding the discrepancy between the plans and elevations on Drwg No 1030/PL02 Rev A, there shall be no windows on the eastern elevation of the projecting wing.
Reason: For the avoidance of doubt. Note: This approval relates to drawing numbers 1030/PL02A and 01 both received on 20 October, 2014. Date of issue: 30 April 2015 By Order of the Minister
