The Town and Country Planning (Development Procedure) (No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Hotel Bell Tent, Ref 14/00921/C, for the temporary change of use from school grounds to campsite in connection with the TT Races for the dates 29th May to 15th June 2015 at Ballakermeen High School St Catherines Drive Douglas Isle of Man IM1 4BE subject to compliance with the following condition(s):

1. The camp site may be available for use no earlier than three days before the first practice associated with the 2015 TT and up to the day after the last race and the camp site may be erected within three days before this and taken down within three days after this. After the 12th June 2015 this approval shall expire.

Reason: the application is for the use of the site for the 2015 TT only and whilst provision should be made for setting up and dismantling the camp site, the site should not be used for camping outside those times reasonably associated with these race periods.

1. There shall be a maximum of 122 tents pitched within the site. There shall be no pitching of tents outside the area outlined green on the site location plan received on 4th August 2014.

Reason: In the interests of public and private amenity.

1. The vehicular access onto St. Catherine Drive's to the south west corner of the site shall be used for vehicular exit only and shall not be used for vehicular entry. There shall be no means of vehicular access directly onto Westbourne Drive to the east.

Reason: In the interests of highway safety.

1. The parking area, as shown on the site location plan received on 4th August 2014, shall not be used other than for the parking of vehicles in connection with the school and camping use hereby approved.

Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety.

This approval relates to Location Plan, Site Plan and Supporting information date stamped as received on 4th August 2014.

Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department.

This permission refers only to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013.

Any appeal against this decision must be in accordance with Article 8 of the Order.

A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

• Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
• The reasons for making the appeal; and
• An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;

• The time for requesting an appeal has expired; or
• Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
