Applicant: Mr Derek Cain Applicant: Mr Derek Cain I refer to the recent appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.

The Minister, the Hon P A Gawne MHK, has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be allowed. Accordingly, he has directed that the Planning Authority's refusal of the application under Article 6 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 should be reversed, and that the application should be Approved subject to conditions. Formal notice of this decision is attached.

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, the Hon P A Gawne MHK, does hereby in the name of and on behalf of the Department APPROVE planning application 14/00800/B by Mr Derek Cain for Motor home site with shower/toilet block, plus camping at Field 411363 and part of Field 411361, Truggan Road, Port St Mary, IM9 5LD, subject to the following condition:

1. The development hereby approved shall commence before the expiration of four years from the date of this notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure)(No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

1. The campsite hereby approved shall not be used between the end of October and the first week in April or Easter (whichever is the earliest).

Reason: To ensure that the campsite is used only to provide tourist visitor accommodation.

1. There shall be no more than 6 motor homes on the site at any one time, and they shall occupy Pitch Nos 1, 2, 3, 15, 16 and 17, as shown on Drwg No C/9004/1(d), and no other pitches.

Reason: In the interests of highway safety, and to protect the character of the countryside.

1. Before development starts, details of the number, appearance and location of any "glamping pods" shall be submitted to and approved in writing by the Department. The "glamping pods" shall be installed in accordance with approved details.

Reason: In the interests of the character and appearance of the site and its surrounding area.

1. Before the development starts, a landscaping scheme shall be submitted to and approved in writing by the Department. It shall include details of all hard surfaces, and all new trees and hedges together with a programme for their planting. The scheme shall be implemented as approved. Any tree or hedge plant that, within a period of 5 years from the date of planting, dies, is removed or becomes seriously damaged or diseased shall be

replaced during the next planting season with another of the same species and size.

Reason: To ensure the provision of an appropriate landscape setting to the development.

1. Before development starts, details of any external lighting shall be submitted to and approved in writing by the Department. The external lighting shall be installed in accordance with the approved details. Thereafter, no other external lighting shall be installed without the prior approval of the Department.

Reason: In the interests of the character and appearance of the site and its surrounding area. Note: This approval relates to the 1:2500 location plan and Drwg No C/9004/1(d) received on 4 July 2014. Date of issue: 2 December 2014 By Order of the Minister
