dwellings should be restricted to four as per the previous approvals in 2009 and 2011. The reduction of the previous scheme from six dwellings to five does not go far enough to overcome the refusal of the previous application. 18. Accesses onto the highway are a source of conflict for both vehicular and pedestrian traffic; where the visibility is below the standard required for a driver to see and respond to an emerging vehicle or below the standard required for the driver of an emerging vehicle to judge when there is sufficient clear road for them to emerge safely then the risk of a collision increases. The greater the number of vehicles and pedestrians using the access the greater the risk of a conflict. Increasing the number of dwellings will increase the vehicle and pedestrian movements and increase the level of risk on the highway. 19. The development would therefore be served by a substandard access and would result in an unacceptable danger to users of the highway. The application should be refused for this reason. 20. Each dwelling would have sufficient parking for two vehicles to park within each plot, therefore, meeting the standard of Transport 7 of the Strategic Plan. There would also be sufficient room for vehicles to turn within the development, and therefore enter and leave in a forward gear. ## Drainage 21. There has been much concern raised by local residents about drainage of the site, particularly the open channel at the bottom of the site along the north west site boundary. These concerns have been shared with the Manx Utility Authority. The Manx Utility Authority has advised that they are satisfied that a detailed scheme which would address these concerns can be achieved. They consider that it is not necessary for the scheme to be provided in advance of planning approval being granted and that it would be reasonable to require the details as a condition to the planning approval, if granted. It is considered that the concerns of residents about drainage and flooding can therefore be adequately addressed. ### Recommendation 22. It is recommended that the application is refused. ### Party Status

The local authority, Lezayre Parish Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2013, paragraph 6 (4) (e), considered "interested persons" and as such should be afforded party status.
