The proposal covers renovation works to an existing cottage and outbuilding, with alterations to window and door openings, construction of a detached garage and store, erection of a wall for privacy, and creation of a new vehicular access with an associated driveway and parking area. The committee assessed the scheme against Isle of Man Strategic Plan policies covering general development, housing, environment, and transport. The key planning issues were the impact on the character and appearance of the existing building and surrounding landscape, the amenity of the neighbouring property, and parking and highway safety. None of these impacts were found to be unacceptable, and the proposal was permitted subject to six conditions.
The committee found no unacceptable adverse impact on the character of the building or surrounding landscape, on neighbouring residential amenity, or on parking and highway safety. The proposal was judged to accord with the relevant Isle of Man Strategic Plan policies and was permitted on that basis.
Condition 1
- 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Condition 2
- 2. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any Order revoking and/or re-enacting that Order with or without modification) no extension, enlargement or other alteration of the dwelling, including the installation or replacement of any windows or doors, hereby approved, other than that expressly authorised by this approval, shall be carried out.
Condition 3
- 3. The development hereby approved shall not be brought into use until the access, visibility, vehicular and pedestrian access and all parking and turning areas, have been provided and surfaced in accordance with the details shown on the approved plans (Drawing Nos. 02P and 04P). Once provided, all access, parking and turning areas shall thereafter be permanently retained as such.
Condition 4
- 4. Within 3 months of the new access coming into use the existing access to the site shall be closed up in full accordance with drawing number 04P, and retained as such thereafter. Reason: The application has been assessed on this basis and in the interest of highway safety.
Condition 5
- 5. Prior to the installation of external finishes and materials, a schedule of materials and finishes and samples of the materials to be used in the construction of the external surfaces, including roofs, shall be submitted to and approved in writing by the Department. The development shall not be carried out unless in accordance with the approved details and retained thereafter. Reason: In the interests of the character and appearance of the site and surrounding area.
Condition 6
- 6. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any Order revoking and/or re-enacting that Order with or without modification), no garages or other free standing buildings shall be erected or enclosure, container for domestic heating purposes for storage of oil of liquid petroleum gas, or the erection of a gate, fence, wall or other means of enclosure, within the curtilage of the dwelling hereby approved, other than that expressly authorised by this approval.
