In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:
Name: Mr Anthony Arnold Kneen Proposal: Approval in principle for the erection of an agricultural worker's dwelling at: Field 432300 Upper Billown Farm Grenaby Road Ballasalla Isle Of Man
which was considered on 25th November 2011, for the reasons set out below. Date of Issue: 2nd December 2011 Murray House Mount Havelock Douglas
RESASON(S) FOR REFUSAL:
- Whilst there is considerable sympathy with the applicant's deteriorating health, the farm does not support a full time labour requirement and the agricultural justification is not taken to include the contracting business as this is not site specific and does not require an on-site permanent presence. As such, there is insufficient agricultural justification for an additional dwelling under the terms of General Policy 3, Environment Policy 15 or Housing Policy 7.
- Nothwithstanding reason 1 above, the siting does not accord with Housing Policy 8 in that it is not within the main farm group and could easily be severed from the farm holding.
Note The applicant is encouraged to consider an extension to the main dwelling to provide accommodation which would be suitable for his and his wife's present and future needs without creating a completely separate dwelling.
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
