The Site
The application site is the curtilage of 4 Derby Road, Peel, an semi-detached property situated on the southern side of the road.
The Proposal
This application seeks approval for the replacement of the existing windows which are white uPVC casements. The proposed windows would be the same as the existing in terms of method of opening, glazing bar arrangement and construction materials.
Planning Status
The application site is located within an area identified as being Mixed Use by the Peel Local Plan. the site is also within the Peel Conservation Area.
Environment Policy 35 of the Strategic Plan states:
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

ASSESSMENT
Environment Policy 35 requires development within Conservation Areas to preserve or enhance the character and appearance of the area. In this case the proposed windows would be the same as the existing. Whilst is would be preferable for the new windows to sliding sash, given that the proposed windows would preserve the existing character of the area, it is judged that the provisions of EP35 would be met by this proposal.
RECOMMENDATION
Permit.
PARTY STATUS
It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Accordingly the following parties are not granted Interested Party Status:
The Highways Division and the Planning Authority are both part of the Department of Infrastructure. As such, the Highways Division cannot be afforded Interested Party Status.
