The site is the residential curtilage of Mill Kent, a large dwelling situated in grounds of 3.2 acres of landscaped garden abutting a private lane to the north west which provides access to the A7 to the north east. This lane is also part of the long distance footpath system. The property is a modern bungalow with conservatory and raised patio on the southern elevation.
The site lies within an area of Private Estate (Existing Low Density Housing in Parkland) on both the Town and Country Planning (Development Plan) Order 1982 and the draft Southern Area Plan. By virtue of the designation, the trees within the site are deemed to be Registered.
Proposed is the installation of solar panels on the south facing roof underneath which is the conservatory. The panels will cover most of the roof pitch - each being 1.7m by 0.5m.
The Strategic Plan states at 12.2.8 - "The Department is fully supportive of the need to secure greater efficiency in new and existing development and has recently introduced additional energy efficiency requirements in the Building Regulations 2003...at the same time the Department
recognises that renewable energy sources can have adverse environmental impacts" Energy Policy 4 states:
"Development involving alternative sources of energy supply, including wind, water and tide power, and the use of solar panels, will be judged against the environmental objectives and policies set out in this Plan. Installations involving wind, water and tide power will require the submissions of an Environmental Impact Assessment."
This work would comply with the proposals within the draft Town and Country Planning (Permitted Development) Order 2005.
The site has been the subject of a number of applications to alter and extend the house, including the creation of a swimming pool (PA 97/2123). None of these previous applications are relevant in the consideration of this latest application.
Malew Parish Commissioners and the Highways and Traffic Division indicate that they do not oppose the application.
The principle of renewable energy is supported by the Department and in this case the solar panels will be affixed to a modern property which is not immediately visible to the public other than from approximately 200m away.
It is considered that this proposal will not have any adverse impact and should be supported.
The local authority, Malew Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

This permission relates to the installation of solar panels as shown and described in the information and plans received on 4th May, 2011.
