This application sought to vary a planning condition attached to an earlier permission for Jacksons Eden Business Park in Braddan. Specifically, it proposed substituting the approved landscape drawing (ref 01 Rev I) with a revised drawing (Hart 32-100), changing the landscaping scheme for the site on the south western side of Cooil Road (A24). The site has been built out and in operation since approximately 2018. The officer's assessment focused on whether the revised drawing still fulfilled the purpose of the original landscaping condition. The revised scheme involves some reduction in screening of the building from the main road, but offers enhanced screening toward the countryside and the adjacent site. The application was approved by delegated decision on 11 November 2022, with two conditions attached.
The application was approved on 11 November 2022. The key planning question was whether the revised landscape drawing adequately addressed the original reason for the landscaping condition. While the updated plan results in some reduction in screening of the building from the main road, screening toward the countryside and the adjacent site is enhanced, which was considered acceptable overall.

General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (a) is in accordance with the design brief in the Area Plan where there is such a brief; (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; (e) does not affect adversely public views of the sea; (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways; (j) can be provided with all necessary services; (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding; (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and (n) is designed having due regard to best practice in reducing energy consumption. 6.3 Development outside of areas zoned for development
Condition 1
This approval only relates to the proposed amendments to the tree planting only, as shown on Hart 32-100.
Condition 2
All additional tree planting as shown on Hart 32-100 shall be carried out in the next available planting season, unless an alternative planting season is agreed in writing with the Department, then the planting shall be carried out as per that agreement. Any planting which, within a period of 5 years from the completion of the development, in the opinion of the Department is dying, being severely damaged or becoming seriously diseased, shall be replaced by plants of similar size and species to those originally required to be planted. Once provided, all hard landscaping works shall thereafter be permanently retained.
