This approval is in relation to the submitted NB033 - CONDITION 6 - UPDATED 12.11.25 document which was submitted on the 12.11.2025.

1.0 Description - 1.1 The proposed application 23/01511/REM was approved on 28.03.2024 for the Alterations to the design of the main house and smaller ancillary house subject to 14 conditions some of which required submission of additional information prior to the commencement of works. - 1.2 This report is specific to Condition 6 which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition as follows:
Prior to the commencement of development, including construction and enabling works, a plan detailing measures to be taken to prevent water, sediment and pollution runoff from site, including measures to prevent the degradation of the neighbouring Douglas Bay Marine Nature Reserve and measures for the avoidance of light pollution onto surrounding habitats.
All works shall be undertaken in full accordance with the approved details during the construction phase of the development. Reason: In the interests of biodiversity.
2.0 Proposal - 2.1 The applicant has submitted NB033 - CONDITION 6 - UPDATED 12.11.25 which outlines measures to prevent pollution, sediment runoff during construction at Howstrake, to prevent degradation of the neighbouring Douglas Bay Marine Nature Reserve and surrounding habitats. This includes controls such as silt fencing, bunded fuel storage, wheel washing, waste segregation, and weekly monitoring. Information was also submitted with regards to the control of light pollution within the report.
3.0 Consultation - 3.1 DEFA Ecopolicy was consulted for advice on the satisfaction of condition. The advice received on 11/11/2025, after their review of the submitted documents, concluded that they are happy with the information provided and that it is important that that measures are put in place as soon as possible to prevent pollution of Douglas Bay MNR.
4.0 Recommendation - 4.1 In the instance of the submitted NB033 - CONDITION 6 - UPDATED 12.11.25 document and after consultation with the Ecopolicy officer, who are content with the level of detail, it is deemed sufficient and would be considered satisfactory for planning condition 6 of application 23/01511/REM with the understanding that all works shall be undertaken in full accordance with the approved details during the construction phase of the development.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded interested person status and/or rights to appeal.
