An appeal to the Department has been lodged against the abovementioned planning application which accords with the Town and Country Planning (Development Procedure) Order 2019, Article 10.
Article 10(8) of that Order requires the Department to forward the appeal to the Office of the Chief Secretary (CABO) for onward referral to a planning inspector.

For your information, once appointed the planning inspector must then comply with the obligations of their role as set down in Article 12 which includes;
- Must consider the application and any written submissions made with respect to it;
- May elect for the matter to be considered as an inquiry should they consider that any interested person be unduly disadvantaged if it is to be determined means of written representation
- May in the case of an inquiry only, hold a pre-inquiry meeting to be convened on his or her behalf by the Chief Secretary;
- Must in the case of an inquiry only, give to the appellant, the Department and every interested person*, an opportunity to appear before him or her on a date fixed and to make oral representations and to call and examine witnesses;
- May invite any Government Department (including any Division of the Department) or any other body or person to provide technical advice;
- Must make to the Department a report in writing that includes the planning inspector’s recommendations as to the determination of the appeal.
The Minister, on behalf of the Department, will consider the report of the planning inspector before making a decision on the appeal.
Please be aware that in order to process this appeal your personal data will be shared with the CABO. The handling of your data will accord with the DEFA Policy acknowledged in submitting your original application.

Please also note that where an inquiry (hearing) is held and an appellant fails without reasonable cause to appear at the fixed time and place (under Article 12(1)(d) - an inquiry), they may be held liable for costs and expenses incurred by the Department or any interested person in connection with the appeal.
As soon as is possible after reaching a decision the Department will give notice in writing to all parties. Such notice will include details of where the planning inspector’s report may be viewed and, where a decision may not follow the recommendation of the planning inspector, the reasons for the Departments decision.
