In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Infrastructure does hereby APPROVE the following application made on behalf of:

which was considered on 25th August 2011, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This approval relates the demolition of existing dwelling, erection of a replacement dwelling, increase in residential curtilage and refurbishment of existing stone barns, Ballarhenny Farm, Orrisdale, Kirk Michael as shown by drawings 1962/10/01, 1962/10/02, 1962/10/03, 1962/10/04, 1962/10/101, 1962/10/102, 1962/10/103, 10TS017-01-Sheet 1, 10TS017-01-Sheet 2, 10TS017-01-Sheet 3, 1962/10/121, Tree Survey 01, Tree Survey 02, Concept Landscape Proposal 03, Concept Landscape Sections 04, 1962/10/131, 1962/10/132, 1962/10/133, 1962/10/134, 1962/10/135, 1962/10/111 all received 19th April 2011.
- All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwelling, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
- PRIOR to the commencement of any building works a photographic survey must be undertaken to record all existing internal and external features of interest and provided for approval by the Planning Authority. Such a record must be prepared in consultation with the Building Conservation Officer of the Department.
- Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval).
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
Guidance Note
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
