In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr Thomas D Robson Proposal: Erection of a dwelling to replace existing redundant agricultural building at: Land forming part of Winterbrook Cottage Ballaragh Road Laxey Isle of Man IM4 7PG

Reason(S) For Refusal:
- The proposed development is contrary to the land use designation of the application site under the Laxey and Lonan Area Plan Order 2005 and the presumption against development set out by planning policies contained within the Laxey and Lonan Area Plan Order 2005 and the Isle of Man Strategic Plan 2007. Specifically, the proposal is contrary to policies L/RES/PR/1 and L/OSNC/PR/1 of the Laxey and Lonan Area Plan Order 2005 and Environment Policy 1 and Environment Policy 2 of the Isle of Man Strategic Plan 2007. The proposed development does not constitute an exception to the presumption against development under General Policy 3 and Housing Policy 4 of the Isle of Man Strategic Plan 2007.
This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
