The application site comprises land located within the Milntown Estate in Lezayre. The Milntown Estate is listed on the Protected Buildings Register due to its significant architectural and social interest.
The proposed development comprises the installation of car park lighting and the creation of landscaped grass mounding to the parking area. There is a concurrent Registered Building consent application (08/02049/CON) for the proposal.
The Milntown Estate has been the subject of a number of previous planning applications, one of which is considered specifically material to the assessment of this current planning application:
Planning application 07/02155/GB sought approval for alterations and extensions to the existing house to create a restaurant, shop, public access and parking areas including the demolition of existing lean to conservatory. This previous planning application was considered and approved on the 11th April 2008, with the approval decision notice issued on the 16th April 2008.
REPRESENTATIONS
Lezayre Parish Commissioners recommend that the planning application be approved. They expressed the view that white lighting would be preferable.
The Department of Agriculture, Fisheries and Forestry's Wildlife and Conservation Division do not oppose the planning application. However, given the likelihood of feeding bats within the area they recommend that lighting levels be as low as possible, that the height of lighting columns be as low as possible and that low or high pressure sodium lamps be used instead of mercury or metal halide lamps.
In terms of land use planning the application site is designated within a) an area of low density housing in parkland; and b) an area of high landscape or coastal value and scenic significance under the 1982 Development Plan Order.
In terms of strategic plan policy, in addition to policies that identify general planning considerations applicable to the assessment of the planning application, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current application:
Environment Policy 32 states:
"Extensions or alterations to a Registered Building which would affect detrimentally its character as a building of special architectural or historic interest will not be permitted."
The planning application seeks approval for the installation of car park lighting and the creation of landscaped grass mounding to the parking area. The proposal has been the subject of pre-application discussion involving the relevant Planning Officer, the Building Conservation Officer and the applicant's agents. The car parking area and layout has extant planning approval through previous planning application 07/02155/GB. The proposed lighting comprises the installation of 5 no. 4.39m high Oxford column lights (black) and 4 no. 1.00m high Vivara bollard lights (aluminium). The proposed landscaped grass mounding comprises 3 relatively modest bunds that are designed to aid screen the car parking and entrance drive.
In terms of impact on the character and appearance of the Registered property the level of proposed lighting is relatively modest and in keeping with the overall Milntown Estate. The need for lighting within the car parking area for public safety is self evident and the manner in which it has been proposed within this planning application is appropriate to the historic character of the overall estate. Similarly, the impact of the proposed landscaped grass mounding on the character and appearance of the Registered property is suitably limited by the scale of the proposed landscaping. The overall impact of the proposed development on the setting and the appearance of the Registered property is acceptable.
In terms of impact of the proposed development on public and private amenity the application site is located significant distance from private residential property and is not readily visible from outside of the Milntown Estate. As such, it's impact on public and private amenity is duly limited and therefore acceptable.
It is recommended that the planning application be approved.
