In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Empress Containers Pension Fund Proposal: Demolition of existing stone warehouse and erection of a block of four apartments with ground floor parking and amendments to the mansard roof windows on adjacent residential/office building at: 1 & 1a Lake Road Douglas Isle of Man IM1 5AE
which was considered on 30th April 2009, for the reasons set out below.

Reason(S) For Refusal:
- The proposed development would be contrary to General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2007 and Planning Policy Statement 1/01 by reason of its height, design, massing and external appearance in that it will introduce a prominent and incongruous development within the streetscene which will not preserve or enhance the character and appearance of the Conservation Area and will be detrimental to the visual amenities of the locality.
- The proposed development would be contrary to General Policy 2 and Housing Policy 6 of the Isle of Man Strategic Plan 2007 by reason of its height, design and massing in that it would result in overshadowing, overlooking, loss of light, loss of privacy, visual intrusion and being overbearing which would affect adversely the residential environments of Numbers 6 and 8 Bridge Road.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
