THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling that is located towards the southern end of Glen Auldyn in Lezayre. The proposed development comprises the alteration and extension of the dwelling contained within the application site. PLANNING HISTORY
The application site has been the subject of one previous planning application that is considered specifically material to the assessment of this current planning application. Planning application 04/02144/B sought approval for the construction of a two storey onto the rear elevation of the dwelling. This previous planning application was considered and approved on the 10th December 2004, with the approval decision notice issued on the 20th December 2004. Planning approval expires on the 20th December 2008, there is no evidence that the development permitted under this planning approval has been commenced.
REPRESENTATIONS
Lezayre Parish Commissioners recommend that the planning application be approved.
The Department of Transport Highways Division do not oppose the planning application.
The Department of Transport Drainage Division do not oppose the planning application.
The Department of Agriculture, Fisheries and Forestry's Inland Fisheries Division express an interest in the planning application and request that development be a minimum of eight metres from the watercourse in order to minimise the risk of damage or disturbance to the river banks and river bed.
The Manx Electricity Authority expresses an interest in the planning application.
In terms of local plan policy, the application site is located within a wider area of land that is designated as being predominantly residential use under the 1982 Development Plan Order.
In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application. General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Paragraph 8.12.1 of the Isle of Man Strategic Plan 2007 states "As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general."
The planning application seeks approval for the alteration and extension of the dwelling contained within the application site. The proposal comprises the re-building of an existing part of the dwelling and two-storey extension onto the side/rear elevation. In terms of the representation from the Department of Agriculture, Fisheries and Forestry's Inland Fisheries Division it should be noted that the application site is located significantly further than eight metres from the nearest watercourse.
The proposed development is in keeping with the character of the existing dwelling and does not unduly affect the residential amenity of neighbouring properties. As such the proposed development satisfies the provisions of General Policy 2 of the Isle of Man Strategic Plan 2007.
It is recommended that the planning application be approved.
