The site represents the curtilage of the Manx Society for the Prevention of Cruelty to Animals facility situated between Higher Foxdale and The Eairy Dam, to the north of the A24 highway. The site accommodates a range of buildings, mostly kennels and pens for animals, with a cafe facility, residential accommodation and offices. Access to the site is directly from the A24 by way of an in and out system with car parking between the access and exit points.
The site lies within an area of "white land" on the Isle of Man Planning Scheme (Development Plan) Order 1982, that is, not designated for development.
Various applications have been submitted in respect of this site for the range of buildings which are presently on site. Perhaps the most relevant of the previous applications is that for the erection of five lamp posts, PA 01/1345, which was refused at appeal for reasons relating to the appearance of
The lights in a rural area. Permission was then given for five 4m high lamp posts under PA 02/1014 although the approval notice refers to five 3.5m high lighting columns.
Proposed is the installation of lighting to illuminate an exercise area to the east of the buildings. The light will be 4m in height fitted with two Son lamps (illustration provided) to be illuminated between 0645-0730 and 1700-1915hrs between October and February when animals need to be walked outside and natural light is poor. The lighting will be on a timer to control these periods.
The lighting permitted under PA 02/1014 was permitted to be illuminated between 0700-0800 and 1600-2100hrs.
Malew Parish Commissioners do not object to the application providing that the times of lighting are adhered to.
The lighting pole when the light is not illuminated will not have an unacceptable visual impact due to its location alongside existing vegetation which will help screen it and any light spillage from the views to the north.
Other than for a 15 minute period in the morning, the lighting will be illuminated within the times when the car park lighting is illuminated.
Advice from the Environmental Protection Unit suggests that there is no controls over artificial light nuisance. In order to reduce sky glow and help minimise visual intrusion within the landscape, full horizontal cut off luminaires installed at 0 degrees should help reduce uplift and assist in minimising the impact. This should be required by condition. Sky glow is particularly important here due to the proximity of the observatory.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a pole and light as shown and described in the drawings received on 1st September, 2008.
C 3. The light must be fitted with full horizontal cut off luminaires installed at 0 degrees uplift in order to reduce sky glow and help minimise visual intrusion outwith the area to be illuminated. These luminaires must be installed prior to the operation of the lighting.
