SITING (RETROSPECTIVE) OF TWO CONTAINERS FOR IMPLEMENT, MACHINE, AGRICULTURAL VEHICLE & TOOL STORAGE and PORTABLE WC IN ASSOCIATION WITH HORTICULTURAL USE OF FIELD AND USE OF VAN AS MOBILE FIELD SHELTER

Ms Kelly and Mr Skillicorn utilise the field for horticultural purposes rotating different parts of the field for growing vegetables and fruit. They are gradually increasing the proportion of the field they crop each year. The containers are used for the storage of implements and machinery - including a tractor, rotivator, topper and plough - and tools for their repair all used in connection with horticulture.
The containers are near the north-east end of the field furthest away from the road side - see photograph. The portacabins are "end-on" to one another. One has been located on the field for nearly three and a half years, the other two, prior to my clients being advised that they were required to have planning consent for them. They have little impact on the landscape being flat roofed, painted dark green and with a screening hedge growing in front of them. Additional fruit bushes and trees are planted nearby. Other materials stored nearby are for fencing and construction of cold frames. For such work a saw is also required.
The field access and track to them has existed for many years. It is only used by my clients' van and car. There is no selling of produce or intention to sell produce direct from the site.
The field as a whole is already well screened on the south-east, south-west and north-east sides by trees. Additional planting of trees has been undertaken along the north-western boundary.
Ms Kelly and Mr Skillicorn are resident in Peel. There is no suitable land for them there to carry out their horticultural operation. Accordingly they obtained the current field three and a half years ago. The return journey to Peel is some 25 miles. My clients are both in full time employment elsewhere. Hence when they go to work on their site it is, good weather and bad, for whole days at a time - generally weekends, and evenings. Ms Kelly does not drive. When on her own she uses public transport to reach the site. Hence a "converted" van which is mobile is used for shelter.
Ms Kelly and Mr Skillicorn have had on site discussions with Mr C. Balmer, Planning Officer and have attempted to establish from the Planning Division what necessity there is for planning consent for portable / mobile structures. They have not been advised that planning consent for a mobile van is required. Mr Balmer was in agreement that there was no material change of use of the site. As above Ms Kelly and Mr Skillicorn are resident in Peel; there is no intention to use the site for permanent residential use.
While the site itself is on a bus route public WCs are some three miles away in Andreas or Sulby and are clearly not reachable by Ms Kelly when she is on the site on her own. Additionally following a heart attack Mr Skillicorn is on medication which requires above average use of WC facilities. The WC which is a portable structure is located behind the containers and not visible from any public viewpoints.
