THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises the curtilage of a detached dwelling that is located within St. Stephens Meadow in Sulby, Lezayre. The proposed development comprises of the erection of a garage extension onto the side of the dwelling. PLANNING HISTORY
The application site has been the subject of a number of previous planning applications that has resulted in the existing dwelling. It is considered that there are no previous planning applications that are specifically material to the assessment of this current planning application.
REPRESENTATIONS
Lezayre Parish Commissioners express an interest in the planning application and state that they understand that a covenant exists on this property whereby the frontal appearance of the property is not to be changed. They would like this to be investigated.
The Department of Transport Highways Division do not oppose the planning application.
In terms of land use planning, the application site is located within a wider area of land that is designated as being predominantly residential use under the Sulby Local Plan.
In terms of strategic plan policy, although the Isle of Man Strategic Plan contains policies identifying general planning considerations that are applicable to the assessment of a planning application it is considered that there are no specific policies within the plan that are material to the assessment of this current planning application.
The planning application seeks approval for the erection of a garage extension onto the side of the dwelling. In terms of the proposal it is considered that the proposed extension is in keeping with the existing dwelling and that surrounding public and private amenity is not unduly affected.
The issue of covenants is a matter of civil law outside of the control of the planning system. As covenants can be placed on land for a variety of, often non-planning related, reasons and the power to enforce such covenants is not invested within the Planning Authority they are not material planning considerations.
It is recommended that the planning application be approved.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Lezayre Parish Commissioners; and The Department of Transport Highways Division.
