In pursuance of powers granted under the above Act and Regulations the Department of Local Government and the Environment has given EXPRESS CONSENT to Abertay Limited for the placement, erection and/or display of adverts in accordance with the planning application and drawings submitted by or on behalf of the applicant and approved on the 6th November 2008.
In compliance with the requirements specified hereunder and generally in accordance with the requirements of the Control of Advertisements Regulations 2005, the proposal now given consent is for:

b) Any advertisements displayed, and any site used for the display of advertisements, shall be maintained in a clean and tidy condition to the reasonable satisfaction of the Department.
c) Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a safe condition.
d) Where an advertisement is required under these Regulations to be removed, the removal shall be carried out to the reasonable satisfaction of the Department.
e) No advertisement is to be displayed without permission of the owner of the site or any other person with an interest in the site entitled to grant permission.
f) No advertisement shall be sited or displayed so as to obscure, or hinder the ready interpretation of any traffic sign, railway or tramway signal or aid to navigation by water or air, or so as to render hazardous the use of any highway, railway, tramway, harbour or aerodrome.

This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
This permission refers only to that required under the Control of Advertisements Regulations 2005.

The application site is within a Conservation Area. The advertisements are relatively modest on the awnings and will not adversely affect the character and appearance of the Conservation Area.
The Highways Division do not oppose the application subject to 2.3 m clearance between from the lowest part of the awning and the public footpath. The applicant has provided details of the clearance which complies with the Department of Transport's requirements.
It is recommended that express consent to display the advertisements be granted subject to conditions.

This consent relates to the retention of two awning with logos as shown in drawing numbers SC1121/P/10-00 date stamped 12th August 2008 and SC1121/P/10-05 Rev A date stamped 30th October 2008.
