The site represents the curtilage of Foxdale Primary School, an existing modern facility in the heart of Foxdale opposite the industrial area and to the immediate south of the River Neb.
The site is designated as "Primary School" and "Playing Field" on the Foxdale Local Plan approved by Tynwald in 1999.
The following previous planning application is considered relevant in the assessment and determination of this application:
05/92365/B sought approval for the erection of ramps and steps for disabled access. This was approved.
The Department of Transport Highways Division has not commented on this application.

Patrick Parish Commissioners raise concerns that some of the lighting may adversely affect properties to the north west of the site. They recommend that two of the proposed lamp posts be re-sited.
The Manx Electricity Authority has commented on this application advising that there are overhead lines/underground cables within the application site.
There have been no privately written representations in relation to this planning application.
This application seeks approval for the installation of external lighting which would replace the existing scheme of lighting in place on the site. There would be 8 lamp posts installed, replacing 12 existing lamp posts. 13 wall lights would be installed to the building itself and 2 existing lights fitted to the entrance canopy would remain in place. It is stated that the existing lighting is operational between 7am and 8:30 am and between 4pm and 10 pm daily. It is proposed to continue with this use. An override system would be in place to ensure that the lights are not in use when the building is unoccupied and secured by alarm.
ASSESSMENT
The main issue to be considered in the assessment of this application is whether the proposed lights are acceptable in this location and whether there would be an unacceptable impact upon the amenity of any properties as a result of this proposal.
The lighting columns would be taller than those currently installed on the site although this would allow fewer lights columns to be installed. The existing columns facing on to the existing properties to the north west are approximately 5 metres tall whereas the proposed columns would be 6 metres in height. The existing lights face in the direction of the opposing properties as they are situated so as to light the access path to the school. It is judged that the 1 metre in crease in height would not result in such an additional impact so as to warrant the refusal of this application. A condition should be attached requiring the lights to be shrouded so as to direct light only onto the area demarcated as the area of light spread on the submitted plan.
It is considered that the proposed lights would represent an acceptable development in this area given that the lights would clearly relate to the building and its use and would not be excessive. The proposed hours of use would seem acceptable and the use of an override system would ensure that unnecessary lighting would not occur.
RECOMMENDATION It is recommended that the application be permitted. PARTY STATUS

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the installation of replacement lighting at Foxdale Primary School, Mines Road, Foxdale, as shown by the plans 01-01-07-004, Lighting 1 and Lighting 2 submitted and date stamped 19th August 2008.
C 3. All lighting must be shrouded so as to direct light only onto the application site and must be retained as such thereafter.
C 4. The approved lighting may be used between 0700 and 2200 hours daily and must be fitted with an override system which turns the lighting off when the building is secured and not occupied.
