THE APPLICATION SITE AND PROPOSED DEVELOPMENT The application site comprises of land contained within Snugborough Trading Estate in Braddan. The proposed development comprises the erection of a building for waste management purposes on the application site.
Whilst the application site has been the subject of previous planning applications it is considered that none of these are specifically material to the assessment of this current planning application.
Braddan Parish Commissioners do not object to the planning application. The Department of Transport Highways Division do not oppose the planning application. The Department of Transport Drainage Division do not oppose the planning application.
The Department of Agriculture, Fisheries and Forestry Inland Fisheries Development Manager have no object to the proposed development provided a minimum distance of 8 meters is retained from the river.
In terms of local plan policy, the application site is within an area recognised as being within predominantly industrial use under the Braddan Parish District Local Plan. There are no policies with Planning Circular 6/91, the written statement that accompanies the local plan, which are considered specifically material to the assessment of the planning application.
In terms of strategic plan policy, although the Isle of Man Strategic Plan contains policies identifying general planning considerations that are applicable to the assessment of a planning application it is considered that there are no specific policies within the plan that are material to the assessment of this current planning application.
Planning approval is sought for the erection of a waste management building on the application site. The submitted planning application states the building would be used to store non-toxic and inert waste material prior to its transportation off Island.
In terms of consideration, the material stored within the building is not considered to be a material planning consideration as the material stored will be subject to control through a Waste Disposal Licence under the Public Health (Licensing of Waste Disposal) Regulations 1990. The assessment is therefore of a storage building and in that in regard the main issues to consider are visual impact and traffic impact.
In terms of visual impact the proposed building is located within the existing estate and is not to be objectionable. In terms of traffic impact it is considered that the size of the proposed building relative to its location within the existing estate is unlikely to generate unacceptable levels of traffic. In respect of the representation from the Department of Agriculture, Fisheries and Forestry Inland Fisheries Development Manager it should be noted that the position of the building is located approximately 28 metres from the adjacent watercourse.
It is recommended that the planning application be approved.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:
Braddan Parish Commissioners; The Department of Transport Highways Division; The Department of Transport Drainage Division; and The Department of Agriculture, Fisheries and Forestry Inland Fisheries Development Manager.
